As a result of the COVID-19 pandemic, the insurance industry is facing the greatest challenge to its existence in the modern era. Significant business interruption claims will be presented for which the insurance industry has no effective precedent to guide their policy. This will inevitably lead to denials of coverage and litigation which will, in turn, lead to either (or both) state and national efforts to find or impose solutions that rarely benefit insurers. Rick and Rod have nearly a century of combined experience in the insurance industry. Rod is a retired senior insurance executive, known and respected in both foreign and domestic markets for his analytical insight and ability to create insurance solutions. Rick has a history of success in insurance operational and regulatory issues, both as a member of three of the United States’ largest insurers, in governmental service, and in private consulting practice.

The following are representative samples of GIC’s engagements for business interruption matters.

• Settled or arbitrated claims of business interruption and asset impairment in international matters resulting from breach of contract, denial of justice, nationalization/confiscation, terrorism, and civil disturbance in Colombia (FARC), Pakistan, Turkey, Russia, Ukraine, Argentina, Venezuela, Egypt, etc. 
• Developed a consulting practice for the evaluation, documentation and presentation of business interruption claims for a major commercial property insurer.
• Retained as expert to defend against allegations of negligence, violations of the State Insurance Code and “bad faith” claims conduct resulting from denial and delayed processing and payment of a business interruption loss. The insured owned a ski lodge which had several key employees who were lost due to non-payment of wages. The insured eventually was forced to cease business operations.
• Retained as consultant by owner of an apartment complex to advise on compilation of a business interruption loss totaling millions of dollars resulting from destruction of the insured premises by a tornado. Controversies surrounded the period of restoration, partial habitation of the large complex and baseline accounting for rental operations.
